By registering for Frosted Faces Foundation's Stroll for Seniors, you agree to be bound by the terms and conditions of the following Waiver and Release:

I understand that participating in Frosted Faces Foundation's Stroll for Seniors (the "Event") involves risks to me and to my pet, including, without limitation, risks of serious bodily injury and/or accidents due to the participation and presence of a large number of individuals and domesticated animals. I assume all risks associated with participating in the Event. I agree not to participate unless my pet and I are physically able, properly conditioned, and my pet has received all legally-required vaccinations when and as required by law, including, without limitation, a rabies vaccination. I also understand that my pet must be leashed at all times.

In consideration for my and my pet's participation in the Event, on behalf of myself, my heirs, executors, beneficiaries, attorneys, administrators and anyone else who may claim on my behalf, I hereby waive, release and discharge Frosted Faces Foundation ("FFF"), its directors, officers, employees, agents, administrators, assigns, attorneys, representatives, affiliates, beneficiaries and successors and the Event officials, volunteers and any sponsors, suppliers, independent contractors and all other individuals and entities in any way assisting or connected with the Event (collectively, the "Releasees"), from any and all claims and actions of every kind or nature whatsoever arising from or connected in any way with my or my pet's participation in this event, notwithstanding that any such claim or action may arise as a result of action or inaction by the Releasees. I understand and agree that FFF does not insure against, and accepts no responsibility for, personal injury, property loss or damage, which I may sustain. It is my intent to release all Releasees from liability for future ordinary negligent conduct. I intend this waiver and release to be as broad and inclusive as permitted by the laws of the State of California, and agree that if any portion is found invalid, the remainder will continue in full legal force and effect.

I understand and agree to permit Event officials to seek medical assistance, including authorizing emergency treatment, for me and/or my pet in the event of any injury or illness. I acknowledge that any costs of medical care or emergency transportation provided, are my sole responsibility. Any decision to use emergency treatment shall be made in the sole discretion of FFF, its assigns and/or agents. I hereby grant FFF permission and right to use, reproduce and display my and/or my pet's name, likeness and photo in conjunction with the promotion of the activities of FFF. Such permission and consent specifically extends to the display of my and my pet's name, likeness and photo in marketing and promotional materials, including videos, and on FFF's website. I hereby release FFF from and against (i) any liability based on any right which I have or may have by virtue of any such use of the name, likeness or photo, or as a result of the exhibition or display of the name, likeness or photo; and (ii) any claim for consideration or compensation for use of such name, likeness or photo or the rights granted hereunder.

Frosted Faces Foundation’s first priority is the safety and health of our attendees, sponsors, entertainers, vendors, volunteers, and staff. We are working closely with our venue and the Health Department to ensure that the Stroll for Seniors will be a fun and entertaining experience that is safe for everyone. As such, all attendees will be required to abide by our COVID-19 Protocol, which will evolve as we get closer to the event and may include any or all of the following measures: liability waivers, face coverings, social distancing, non-invasive temperature checks, testing, or proof of vaccination. Frosted Faces Foundation reserves the right to modify and add requirements at its sole discretion. We will update this page with those protocols as we get closer to the event. Cooperation with published health and safety protocols on-site will be required to enter and participate in the event.

This Waiver and Release has been read by me, completely understood and agreed to voluntarily and I hereby confirm that I expressly agree with the above statements. I am 18 years of age or older.

This waiver, release and assumption of risk is to be binding on my heirs and assigns.
